BOARD OF APPEALS MINUTES
Monday, February 22, 2010
7:00 p.m.
Present: Chairman Lisa Beauvais, Secretary Christine Kumiega-Provost, and Chester Zymroz.
Absent: Planning Director Richard Werbiskis and Alternate Jim Bodurtha
The Chairman called the meeting to order at 7:00p.m.
1. Acceptance of Minutes
Ms. Beauvais moved to approve the minutes of January 25, 2010, as presented; Mr. Zymroz second. UAV.
2. Election of Officers
Ms. Beauvais noted there has been a change in the members of the Zoning Board and Mr. Neffinger’s term had expired and his last meeting was January of 2010. Mr. Zymroz has been appointed as a full-time member of the Board.
Ms. Beauvais moved to have Ms. Kumiega remain as Secretary and to appoint Mr. Zymroz as Vice-Chairman, and Chris noted that Ms. Beauvais would remain as Chairman; Ms. Kumiega second. UAV.
3. Public Hearings
7:00 p.m. (7:03 p.m.) – Paul Gil (Special Permit) – Special Permit from Section 4.21 of the Zoning Ordinance that allows for the change of a non-conforming use at the property located at 204 Baldwin Street in the Business B-1 (BB-1) zoning district.
Ms. Beauvais said the Board recently heard an application on this property about 9- months ago. Mr. Gil said the applicant could not get the financing together to open the store. He would like to remodel the space into a four room apartment that he would move into. They have not been able to utilize this space for commercial purposes; half of the building is residential and half is commercial. They would like to make the house all residential now. There are currently two other residential units so it would become a three-family unit. Mr. Gil said there is a seven room apartment and a three room apartment right now. Both units are occupied at this time.
Ms. Beauvais said they would need six off street parking spaces, two for each unit. Mr. Gil said there is ample parking on site. Ms. Beauvais said the sidewalk and tree belt would be reconstructed by the town in the spring.
Ms. Beauvais said she had no concerns and asked for comments or questions from the Board.
Mr. Zymroz asked where the garage area was on the map provided and Mr. Gil explained there is a two car garage and a six car garage. Ms. Beauvais said there is space for eight cars? Mr. Gil said there are six parking bays.
Ms. Beauvais noted there were no concerns from town departments. Ms. Beauvais noted there was no one in attendance in the audience for comments.
Ms. Beauvais moved to close the public hearing; Ms. Kumiega second. UAV.
Ms. Beauvais said she had no concerns, but was sorry to lose the convenience market at the site, it has been there for so many years. Mr. Gil said he thought it would be better for the town for it to be residential instead of commercial especially with the school next door.
Ms. Beauvais moved to approve the Special Permit for 204 Baldwin Street noting there is plenty of parking and it is conformity with the neighborhood and is in line with all of the other findings of a Special Permit; Mr. Zymroz second. UAV.
4. New/Old Business
No new or old business was discussed.
4. Date of Next Meeting
The next regular meeting of the Board will be held on Monday, March 22, 2010, at 7:00 p.m.
5. Adjournment
Ms. Beauvais moved to adjourn the meeting at 7:20 p.m.; Mr. Zymroz second. The vote was unanimous.
